On July 8, 2024, her nomination was sent to the Senate. President Biden nominated Weilheimer to the seat vacated by Judge Gene E. K. Pratter, who died on May 17, 2024.[236] On July 31, 2024, a hearing on her nomination was held before the Senate Judiciary Committee. Her hearing generated an uproar. Senator John Neely Kennedy pointedly questioned her about the case of Bryan Lapuse, who pled guilty to sexually assaulting an incapacitated patient with Alzheimer’s Disease before Weilheimer, and she sentenced him to only 11 months in prison, as Lapuse allegedly grinned after hearing the sentence. Her nomination is pending before the Senate Judiciary Committee
